RESPONSIBILITY OF SHOOT THE STREET AND PHOTOGRAPHERS ATTENDING THE COURSE:

Mark Seymour will provide educational and creative enrichment for interested participants attending workshops as outlined on the Shoot The Street website.

Mark Seymour and the workshops designated tour guides, drivers and hoteliers shall not be held liable for
(A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider
(B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control.
The participant waives any claim against Mark Seymour and/or its designated tour operator and tour administrator, for any such loss, damage, injury, or death.
Workshop participants are responsible for organising and purchasing their own insurance to cover their travel and health.

By registering for a Shoot The Street workshop, training, expedition, or personally guided tour, the participant certifies that he/she does not have any mental, physical, or other condition or disability that would create a hazard for him/herself or other participants; and they are aware of any associated risks created by field locations, activities and weather; that they agree to follow the instructors’ directions, particularly in matters of personal and group safety, including but not limited to the importance of hydration, need for nutritious snacks, altitude sickness, exhaustion, leave no trace, sunscreen, bug dope, danger of overhangs, footing, vehicle safety, boat safety, hot air balloon safety, helicopter safety, ferry safety, common-sense safety, respect for others, etc.

Mark Seymour and the designated operatives reserve the right in their sole discretion to accept, decline to accept, or remove any participants on a Shoot The Street workshop.

Mark Seymour and the designated operators reserve the right, without penalty, to make changes in the published itinerary whenever, in their judgment, conditions warrant or if they deem it necessary for the comfort, convenience, or safety of participants.

Mark Seymour and the recommended tour operators, hoteliers, transport, nor its tour administrator shall be liable for any air carrier’s cancellation penalty incurred by the purchase of a nonrefundable ticket to or from the participant’s workshop destination . Baggage, personal effects and personal safety are at all times the sole responsibility of the participant.

TERMS AND CONDITIONS

All prices and fares are quoted in U.K £ pounds sterling. The rates are based on current tariffs and are subject to change due to unforeseen circumstances. While we will do everything possible to maintain the listed prices, if it is necessary to levy a surcharge, we reserve the right to do so, and notification will be given at the time of final invoicing.

Eligibility: participants on a Shoot The Street workshops must be 18 or over.

Workshop price: what is included will be detailed within each individual workshop description. If you do not see something as included, you should assume that it is not included. If in any doubt – please contact us for clarification. As a general rule – flights, transfers, accommodation, food, drink, alcohol, tipping, laundry, telephone calls, wifi fees etc is not included, yet where possible we will identify what the course leaders will be doing with their bookings and experiences with the above and you may wish to do the same since we have in most cases, the knowledge of a destination where research and investigation into all or most of the above.

What each participant requires:
Passport and appropriate travel documentation including visas; visa expenses will also remain the responsibility of the individual participant.
Insurance is mandatory, and the full responsibility of the participant to cover and ensure that they have the level of protection that they will need for medical, transportation, baggage, photographic equipment and all other insurance related situations. Shoot The Street does not insure any participant on any course and it is not included within the cost of your course fee.
All of these additional expenses are the responsibility and at the cost of the participant.

The Shoot The Street workshop fee is exclusively for the photographic tuition at the destination and to cover the administrative side of the business including our own costs and fees.

We look to recommend unique hotels which offer cultural, historic and/or authentic features. Depending on the size of the group, smaller boutique hotels may have limited room inventory. In some countries or in remote locations, we may be limited to hotels, lodges, bed and breakfasts or other hotels of lesser quality and there maybe an expectation to share a room.

Payments, Cancellations and Refunds:
To reserve space on a Shoot The Street workshop , a deposit amount is required to secure your place on the workshop.
Deposit amount once paid is non-refundable unless Shoot The Street cancel the workshop.
Balance payments may be made by bank transfer or via our website and is required 120 days prior to the course, if different to this – you will be notified in your invoice or on the course details page of the website.
Your reservation may be cancelled if full payment has not been received by 120 days prior to departure.
For reservations made within 120 days of the departure date, full payment is required within 5 business days of the reservation.

This policy also applies to pre- and post-workshop extensions, excursions, Any revisions made within the Cancellation Penalty Period, such as a change in departure date or choice of workshop are subject to this cancellation policy. Leaving a workshop in progress, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of a workshop.

Minimum Number Level
Shoot The Street workshops are organised with a particular group size and competence level in mind. In order to ensure that the training is as successful as possible for all parti, we have a minimum number of participants required to attend each workshop. Flights should not be booked until Mark Seymour / Shoot the street advises so.

We reserve the right to cancel any workshop due to inadequate enrolment that makes the workshop economically infeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the participants. If a workshop is cancelled prior to departure, we will provide credit toward a future workshop and if this cannot be provided then a refund of monies paid will be due.

If the workshop you have booked has not yet reached the minimum delegate number level; your Credit or Debit Card will be debited in the normal way, but, in the unlikely event that the minimum number level is not reached within 7 calendar days of the advertised workshop date, you will receive an e-mail from Shoot The Street confirming that the workshop has been cancelled and your Credit or Debit Card will be credited with the full amount paid.

For international courses we will endeavor to contact you around 8 weeks in advance of the course start date.

Cancellation Policy:
Should you wish to cancel a booking, for whatever reason, we ask that you provide us with as much notice as possible.
Participants are required to notified Shoot The Street of cancellations 30 days in advance of the start date for any UK workshop fee to be refundable.
Please note that for any international courses there will no refund available 4 months prior to course date.
To cancel a workshop booking, please contact Shoot The Street with your booking information. In exceptional circumstances when a cancellation is made prior to the course running date we may be able to transfer you to another course instead, for this there would be a £200 administration charge, all changes to this would be at the express discretion of Shoot The Street.

If Shoot The Street cancel a workshop that is in progress, you will receive a prorated refund based on the number of days not completed on the workshop . We will not be responsible for any refund for any airline tickets, hotels or other travel costs purchased by the passenger directly from an airline or travel/booking agent.

All refunds concerned with Shoot The Street will be processed within one month.

Shoot The Street strongly suggest travel insurance to protect your investment and it is a requirement of booking on our courses for your own personal safety with medical and equipment protection.It is not the responsibility of mark Seymour or Shoot the street to ensure that you have arranged correct Travel Insurance

Weather: Shoot The Street reserve the right to cancel, reschedule or re-route a workshop up until last minute, due to inclement or unsafe weather conditions, safety or other uncontrollable circumstances. Cancellations will receive a full refund if we can offer this, yet in cases of acts of god, terrorism, or any other circumstance beyond our control, you may need to look for cover from your travel insurance.

Travel Insurance: It is a requirement of Shoot The Street that each participants
purchases travel insurance that protects the individual and their investment in the event of a sudden emergency before or during the workshop and coverage for cancellation or interruption, illness, injury, and damage, loss or theft of baggage, as well as emergency assistance. This applies to deposits and balance due payments. Travel insurance should be purchased by the participants upon booking onto a workshop and as a minimum prior to travel to ensue the individual has the required level of cover for all eventualities. Insurance plans available vary by country and state of residency; please contact your insurer for more information.

Changes to workshops: the itineraries described on this website are subject to modification and change. Every reasonable effort will be made to operate workshops as planned, but alterations may still occur after final itineraries are sent.

Shoot The Street make every effort to provide photographic opportunities during the best possible light, but this is often compromised by daily itineraries and travel schedules. Since the best light is just after sunrise and just before sunset when the sun is low, it is impossible to visit all locations during these limited hours.

Mark Seymour will be available to instruct and train throughout the workshop and facilitate the participants getting the best from the locations, and then as part of group editing critique.

It is important that you arrive with a working knowledge of your cameras settings and each participant has a laptop with editing software. (Please contact Mark Seymour for personal recommendations.)

Mark Seymour provides on-location tuition, in the moment of the action. Some tuition is given with regards to selection of images, editing and final presentation once back at the hotel in the evenings after a day of shooting. Instructions are primarily conducted on site using walk-n-talk techniques. Don’t be afraid to ask questions and use each other for help.

Health Requirements: participants must be in good physical and mental health. You must be able to maintain the pace of the group throughout the workshop. Any physical condition, diet, or treatment requiring special attention must be reported in writing when you register. Failure to participate in daily activities due to physical or mental health will not result in any refund. For special dietary requirements, we do our best to convey this information to restaurants and food establishments, but communication of these requirements to restaurants and food establishments is ultimately the participants responsibility and please recognise that in some areas of the world it can become very difficult to control or accommodate dietary requirements.

Photography: Shoot The Street reserve the right to take photographs or videos during the workshop and to use the resulting photography, videos, or recordings for promotional or commercial use. By making a reservation on a Shoot The Street workshop , the participant agrees to allow his/her likeness to be used by Shoot The Street and Mark Seymour . If the participant prefers that his/her likeness not be used, he/she must notify us in writing prior to departure of the workshop . Copyright in all photographs, video, and related materials created by the participant (“tour Materials”) shall belong to the participant upon creation. The participant grants to Shoot The Street and Mark Seymour non-exclusive, worldwide, irrevocable license to use any future promotion of workshops in any media for the following limited purposes: editorial use, promotion of this editorial use, promotion of Shoot The Street and Mark Seymour.

Force Majeure: Shoot The Street and Mark Seymour will not be liable for any delay in, change to or cancellation of trips due to ‘Force Majeure’. ‘Force Majeure’ means a circumstance beyond the reasonable control of Photo Workshop Adventures and includes, but is not limited to, war or threat of war, riot, civil strife, terrorist activity, act of god, industrial dispute, disease, industrial or nuclear disaster, adverse weather conditions, fire and strikes.

Dispute Resolution: If the participant has a complaint, he/she should first inform Mark Seymour so that he can try and rectify the matter. If the participant is still dissatisfied, he/she should submit the complaint in writing to Shoot The Street within 7 days of the completion of the workshop. Any controversy or claim arising out of or relating to this Agreement, website, brochures, or any other literature concerning the workshop , or the breach thereof, including without limitation any claim related to illness, injury, or death, shall be subject to the following conditions:
1) the dispute will be governed by UK law
2) the parties agree that they will attempt in good faith to settle any and all disputes arising out of, under or in connection with this Agreement, including without limitation the validity, interpretation, performance and breach hereof, through a process of mediation in the United Kingdom under the supervision of a mutually agreed upon mediator.
3) the maximum amount of recovery to which a participant will be entitled under any and all circumstances will be the published cost of the participant’s workshop with Shoot The Street. This agreement to arbitrate does not waive or modify any liability or copyright or model release agreed by the participant.

Other Terms and Conditions may apply to some workshops and will be provided with pre-trip emails or mailings. By registering for a Shoot. the Street workshop the participant agrees to the Responsibility statement and the Terms and Conditions herein.

Prices:
Except where stated otherwise, all prices are inclusive of VAT or there will be no additional VAT chargeable on such workshops .
We may offer discounts on some workshops , only one discount offer can be used at any one time, only one discount can be used at a time.

Other Workshop Information:
Information is provided about each individual workshop . All participants in workshops do so at their own risk. Participants should ensure that they have no physical or health problems, which might make such participation dangerous or hazardous or in any case affect/hinder the good running of the course with their involvement.

Participants are advised to undertake their own risk assessments and due diligence as to the suitability of third party products to meet their requirements. Further, Shoot The Street and Mark Seymour will not accept liability for any loss or damage to a participants property, welfare or health while attending a workshop or travel to and from the workshop destination.
